By making a charter reservation or utilizing our Service, you consent to these Terms. If you do not agree with any section of these terms, you should not access the Service.

2. Service Overview

StillHarborOrchid offers high-quality yacht charter services including, but not restricted to:

  • Daily yacht rentals
  • Sunset cruises
  • Corporate retreats
  • Private events
  • Multi-day charters

Service availability is based on a number of factors including weather. We have the authority to change or cease services at our discretion.

3. Booking and Reservations

3.1 Booking Process

For charter booking, you need to:

  • Be 18 years or older
  • Provide valid and complete information
  • Remit the stipulated deposit as detailed in the booking confirmation
  • Accept these Terms & Conditions

3.2 Confirmation

A booking is regarded as confirmed once payment is made and we provide a written confirmation. We have the right to deny service at our own judgement.

3.3 Availability

Charter reservations depend on yacht availability and favorable weather conditions. Reasonable efforts will be made to accommodate your preferences for dates and times.

4. Payment Terms

4.1 Pricing

All charges are given in € and incorporate applicable taxes unless stated otherwise. Prices may change without prior notification.

4.2 Payment Schedule

  • Deposit: 50% of the full charter fee expected upon booking
  • Balance: Must be cleared 48 hours prior to the charter’s start
  • Extra charges (if present): Payable at the end of the charter

4.3 Payment Methods

We accept primary credit cards, direct bank transactions, and certified bank drafts. Our payment processing is done using secure and encrypted systems.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

  • Over 72 hours ahead of departure: Full refund less any processing fees
  • 24-72 hours before departure: A refund of 50%
  • Under 24 hours prior to departure: No refund available

5.2 Weather Cancellations

Should the weather render conditions unsafe as determined by our captain, we will propose to:

  • Move your charter to an alternative date at no extra cost
  • Issue a full refund if rescheduling cannot be arranged

5.3 Mechanical Issues

In the case of mechanical failures concerning the designated yacht, efforts will be made to arrange an appropriate substitute. Should no replacement be available, a complete refund will be given.

6. Safety and Conduct

6.1 Safety Requirements

Every passenger must:

  • Heed all directions given by the crew
  • Use safety gear when needed
  • Inform us of any health conditions that could affect their safety
  • Stay within assigned areas on the yacht

6.2 Prohibited Items

Certain items are banned from being brought on board:

  • Glassware
  • Illicit drugs
  • Weapons or firearms
  • Pets (unless previously sanctioned)

6.3 Conduct

Behavior should be courteous at all times. We possess the right to terminate a charter prematurely with no refund if a passenger’s actions endanger safety or disturb other guests.

7. Liability and Insurance

7.1 Our Liability

We are liable only to the extent of the charter fee paid by you. We are not liable for:

  • Injuries due to passenger recklessness
  • Personal belongings loss or damage
  • Incidental, consequential, or punitive damages
  • Delays caused by events beyond our control, such as severe weather

7.2 Insurance Coverage

Comprehensive marine insurance that covers both our ships and operations is maintained by us. Passengers are advised to have their own travel and personal insurance coverage.

7.3 Assumption of Risk

Engaging in our charter services suggests you are aware of the inherent dangers of maritime activities and accept the responsibility for personal health and safety.

8. Modifications and Itinerary Changes

We may alter itineraries, routes, or timetables due to reasons like weather, security, or operational demands. Any alterations will aim to provide similar experiences.

9. Force Majeure

Any hold-ups, cancellations, or changes due to factors outside our control, such as but not limited to:

  • Extreme weather events
  • Natural catastrophes
  • Regulatory actions
  • Port shutdowns
  • Vehicular malfunctions

10. Privacy and Data Protection

Your private data is processed following our Privacy Policy. You agree to the collection and utilisation of your data as detailed in our Privacy Policy.

11. Intellectual Property

Our website content, including logos, graphics, and images, is legally protected. Unauthorized reproduction, distribution, or derivative creations are prohibited.
